And they must use them at least eight times out of 10. Falling below that level during a six-month period means that an airline risks forfeiting these rights to eager competitors. Because of this “use it or lose it” rule, airlines operate “ghost flight” routes (with aircrafts that are practically empty). In July 2021, the European Commission reduced the rules for the past winter from 80 percent to 50 percent. But in December 2021, it wanted to increase the threshold to 64 percent for the 2022 summer season with German airline Lufthansa, blaming the Commission for forcing it to operate 18,000 flights during the winter season just to maintain its slot rights, and praising the U.S. for temporarily suspending slot rules. Eurocontrol, however, reported that air traffic for the first six days of 2022 was 77 percent of 2019 levels, indicating that Omicron wasn’t killing airlines’ business. Plus, decisions by some countries to impose flight bans allowed for the so-called justified non-use of slots rule. That means airlines can dip below the minimum level without fear of having to run flights that are mostly empty.
